What Are the People in Hong Kong Worried About?

The June 4th commemoration had just finished, with more than 100,000 people in Hong Kong taking to the streets.  On June 9th, 1,000,000 people took to the streets in Hong Kong again.  That is one out of every seven people in Hong Kong went to the streets to oppose the so-called revision of the Fugitive Offenders Ordinance.  Their slogan is called "Against Extradition to China", which directly points out the essence of the so-called revision of the fugitive offenders ordinance is the extradition to the lawless courts under the rule of the Communist regime in Mainland China.

 

Some friends believe that it may not be a bad thing to extradite a few possible offenders to a tougher place that accepts torture.  This is a big mistake.  This is a wrong mode of thinking caused by the years of brainwashing of the Communist regime.  This logic of the Communist Party is a conclusion based on the stealing concept in sophistry.  One does not have the right to believe that a person is a criminal before the person receives a fair trial.  Since it cannot be determined, then the suspect cannot be treated in the same way as a criminal.

 

Moreover, torture itself is one of the main reasons for false and wrong determinations.  The opposition against use of torture was one of the major reforms of the new criminal law in China in the 1980s.  That reform was also due to the lesson from the abuse of torture in the first three decades of the Communist rule that had caused a lot of unjust and false convictions, thus giving lessons to the whole society.

 

Since the Communist regime itself even recognized the main cause of lawlessness in China was due to its way of conviction and the use of torture, and it self-corrected in the legal provisions as early as forty years ago, then why has it now restored the old system of lawlessness?

 

It has to start from the essence of one-party dictatorship.  Because it is a dictatorship, essentially it cannot tolerate opinions and actions that are different from those of the rulers.  Naturally humans have the instinct of animals that do not like different opinions and behaviors.  The institutional exploration of mankind for tens of thousands of years has been to seek how to limit this authoritarian instinct of the leaders of their social organizations.

 

Democracy guarantees the possibility of limiting the instincts of leaders, while authoritarian politics cannot guarantee to limit the instinct of leaders.  Even the so-called collective leadership of the Communist regime in China is difficult to guarantee.  The history of the Chinese Communist regime itself proves that the so-called collective leadership is nothing but an unstable transitional state.  It will soon resume its original face, with the dictatorship of either the individual or a few.

 

In order for a dictatorship to be maintained effectively, it is necessary to create a climate of terror that applies psychological pressure on all people so that everyone learns to shut up.  If people can use the law as a shield to protect themselves, then the psychological pressures needed by rulers in power will be greatly reduced, and the dissidents who dare to challenge the rule will increase.  The authority of the ruler to realize his will be greatly reduced.

 

Therefore, the system of dictatorship must be a system that does not respect the law.  The political system that is most beneficial to the individuals must respect the law, and that is a political system that respects individual rights.  To date, the most successful system is democracy.  In the past, Hong Kong used to have a legal system that respects individual rights under the democratic political guarantees of the British colonial authorities.

 

Therefore, when the Chinese people were subjected to massacres by the authorities, the people in Hong Kong could not be tolerant and were angry.  They took to the streets to protest, and gave assistance and protection to the Chinese people.  But after all, it was a matter of the other people, out of righteous indignation and sympathy of the Hong Kong people, not of their own personal interest.

 

Now the dirty hands of the Communist regime have reached the own personal interests of the people in Hong Kong.  The people of Hong Kong have finally awakened and know that the life they were used to with legal guarantees is coming to an end.  The autocratic tyranny is about to break through the border and fall on top of their heads.

 

And as in the case of the Mainland China, this dictatorship will penetrate into all aspects of people's lives and is all-encompassing.  Even judges and lawyers don't know if they can enforce the law; and they don't know if they will be retaliated against by the rulers if they enforce the law.  Therefore, they also collectively came forward to protest the extension of the lawlessness in Mainland China into Hong Kong.

 

Jimmy Lai Chee-ying, the Hong Kong media tycoon said something right.  With this extradition law, the Communist regime does not have to go to Hong Kong to kidnap people illegally anymore.  It can directly extradite people they do not like to the lawless courts of the Communist regime, torture them and create false and wrong convictions.  They could create their needed horrific psychological pressure in Hong Kong and expand their tyranny into Hong Kong.

香港人担心什么?

刚刚结束的六四纪念活动,香港有十几万人上街。六月九号又有百万人上街,也就是每七个香港人就有一个人上街,反对所谓的修订逃犯条例。他们的口号叫做“反送中”,直接指出所谓逃犯条例的实质,就是引渡到中共统治的无法无天的法院去审判。

 

有些朋友认为,把少数可能的罪犯引渡到更严厉的地方接受酷刑,也许不是什么坏事吧。这就大错特错了。这是共产党多年洗脑造成的错误思维模式。共产党的这种逻辑,是使用诡辩论的偷换概念做出结论。因为在没有接受公正的审判之前,你无权认定这个人就是罪犯。既然不能认定,就不能用对待罪犯的方式对待嫌疑人。

 

何况酷刑本身是制造冤假错案的主要原因之一。反对使用酷刑,是中国八十年代的新刑法的重大改革之一。也是中共前三十年滥用酷刑造成大量冤假错案,给整个社会带来的教训。

 

既然共产党自己也认识到有罪认定和使用酷刑,是造成无法无天的主要原因,并且早在四十年前就在法律条文上做出了纠正,为什么现在又恢复了无法无天的旧制度呢?

 

这就要从一党专政的本质说起了。既然是专政,它从本质上就不能容忍不同于统治者的意见和行为。或者说人作为动物的本能,就不喜欢不同的意见和行为。人类几万年来的制度探索,就是如何限制作为社会组织领导者的这种专制的本能。

 

民主政治保障了限制领导者本能的可能性,而专制政治则无法保证对领导者本能的限制。即使中共所谓的集体领导制,也很难保证。中共本身的历史就证明了,所谓的集体领导不过是个不稳定的过渡状态。很快就会恢复到它的本来面目,个人或者少数人的独裁专制。

 

而为了专政能有效维持,就必须制造恐怖的气氛,也就是对所有人的心理压力,让所有人都学会闭嘴。如果人们可以把法律当作保护自己的盾牌,当权者所需要的心理压力就会大打折扣,敢于挑战统治权的异议分子就会增加。统治者实现自己意志的权威,也就大打折扣。

 

所以专政的体制,就必须是不尊重法律的体制。而对个人最有利的政治体制,就必须是尊重法律,也就是尊重个人权利的政治体制。迄今为止最成功的就是民主政治。香港过去也是在英国殖民当局的民主政治保障下的,尊重个人权利的法律制度。

 

所以在中国人民遭受当局的屠杀时,香港人民看不惯,很愤怒,上街抗议并且给予中国人民援助和保护。但那毕竟是别人的事情,是出于义愤和同情,不是切身的利害关系。

 

现在中共的魔手直接伸到了香港人自己的切身利害上来了。香港人终于觉醒了,知道自己习惯的有法律保证的生活即将结束。专制暴政即将突破边界,降临到自己的头顶。

 

而且和大陆的情况一样,这个专政会渗入到人们生活的所有方面,无所不包。就连法官和律师都不知道自己还能不能执行法律;不知道如果执行了法律,是否会遭到统治者的报复。所以他们也集体出面,抗议将大陆的无法无天延伸到香港。

 

香港媒体大亨黎智英说得很对。有了这个引渡法,中共就不必违法跑到香港来绑架,可以直接把他们不喜欢的人引渡到无法无天的共产区法院,施以酷刑和制造冤假错案。在香港制造共产党所需要的恐怖心理压力,推广他们的暴政。
